These Terms & Conditions ("Terms") govern the services provided by NextGen Stars LLC ("NextGen", "we", "us", or "our"), operating under the brand name NextGen, to you ("Client", "you"). By requesting a quote, placing an order, or making a payment, you agree to these Terms.
1. Services
NextGen provides digital creative services for e-commerce sellers and brands, including but not limited to Amazon main and secondary listing images, infographics, comparison charts, A+ / Enhanced Brand Content, brand and packaging design, and short-form social media content for platforms such as TikTok, Instagram and Facebook. The specific deliverables, scope, and number of revisions for your project will be confirmed in your quote or project agreement.
2. Quotes, Orders & Payment
- Every project is custom-quoted. We provide clear pricing and scope for your approval before any work or payment begins.
- Payments are processed securely through our third-party payment processor, Stripe. We do not store your full card details.
- Unless otherwise agreed in writing, work begins after the agreed payment or deposit is received.
3. Revisions & Delivery
Your quote specifies the number of revision rounds included. We deliver final files digitally, sized and formatted for their intended platform. Additional revisions or scope beyond the agreed quote may incur additional fees, communicated to you in advance.
4. Client Responsibilities
You agree to provide accurate product information and any assets needed to complete the work. You represent and warrant that you own, or have the necessary rights and licenses to use, any materials (images, logos, text, trademarks) you provide to us, and that our use of them will not infringe the rights of any third party.
5. Intellectual Property
- Upon full payment, you receive ownership of the final delivered files for use in your business.
- NextGen retains ownership of preliminary concepts, working files, and any proprietary methods or templates unless expressly transferred in writing.
- We will not publicly display your project in our portfolio or marketing without your permission.
6. Acceptable Use
You agree not to use our services for any unlawful purpose or to create materials that are deceptive, infringing, or in violation of Amazon's or any other platform's policies.
7. Disclaimer & Limitation of Liability
Our services are provided on a professional-effort basis. We do not guarantee any specific sales, ranking, conversion, or business outcome, as these depend on many factors outside our control. To the maximum extent permitted by law, NextGen's total liability for any claim arising out of or relating to the services shall not exceed the amount you paid for the specific project giving rise to the claim.
8. Cancellation & Refunds
Cancellations and refunds are governed by our Refund, Dispute & Cancellation Policy.
9. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.
10. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of our services after changes constitutes acceptance of the updated Terms.
